Pennsylvania’s top election official had no right to continue accepting mail-in ballots for twice the length of time permitted, a judge has said.
The Commonwealth Court of Pennsylvania has blasted Pennsylvania Secretary of State Kathy Boockvar (D) for allowing postal votes to be counted, even if arriving six days after the original 8 p.m. deadline on Nov. 3.
Although the court had earlier permitted polling stations to count mail-in ballots that arrived on Friday, three days after Election Day, Boockvar acted above the law when she doubled the grace period with just two days’ notice.
“Kathy Boockvar, in her official capacity of secretary of the Commonwealth, lacked statutory authority to issue the Nov. 1, 2020, guidance to respondents County Boards of Elections insofar as the guidance purported to change the deadline … for certain electors to verify proof of identification,” President Judge Mary Leavitt said in the court order. “[This was] based on Secretary Boockvar’s interpretation and application of the Pennsylvania Supreme Court’s decision in Pennsylvania Democratic Party versus Boockvar.”
Leavitt also ruled that postal votes must be excluded from the final count, if proof of identification was provided between November 10 and 12 [after the Nov. 9, six day grace period].
“The court hereby orders that respondents County Boards of Elections are enjoined from counting any ballots that have been segregated pursuant to paragraph one of this court’s order dated Nov. 5, 2020, granting a special injunction,” she said.
The decision represents a victory for the Trump 2020 campaign team, which maintains at least 52 percent of about 140 million legal voting ballots supported giving President Donald Trump another four years in the Oval Office.
The president accused the Democratic Party of using several questionable tactics to try to seize the presidency from him.
“Data analysis finds 221,000 Pennsylvania votes switched from President Trump to Biden [and] 941,000 Trump votes [were] deleted,” he said on Twitter.
He also believes digital voting technology could have been compromised.
“States using Dominion voting systems switched 435,000 votes from Trump to Biden,” he said. “Dominion deleted 2.7 million Trump votes nationwide.”
Democrats have also allegedly prevented Americans from scrutinizing election results in those states, allowing an estimated 350,000 illegal postal votes to be counted in Pennsylvania even though they had no visible postmark to verify whether the ballot was mailed before the original deadline.
“Nobody wants to report that Pennsylvania and Michigan did not allow our poll watchers and/or vote observers to watch or observe,” the president said on Twitter. “This is responsible for hundreds of thousands of votes that should not be allowed to count. Therefore, I easily win both states. Report the news!”
